Terms of Service

Please read these Terms of Service carefully before using the Formu-Letter Microsoft Excel Add-in (the "Service").

1. Acceptance of Terms

By installing or using the Service, you agree to be bound by these terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that entity to these terms.

2. Description of Service

Formu-Letter provides tools within Microsoft Excel to facilitate personalised email merges. The Service operates as a client-side Add-in and relies on the Microsoft 365 ecosystem for authentication and email delivery. Emails are sent from your own Microsoft account via the Microsoft Graph API.

3. Account & Access

The Service requires a valid Microsoft 365 account with an active Exchange Online mailbox. You are responsible for maintaining the security of your Microsoft account credentials. We do not create or manage user accounts — authentication is handled entirely by Microsoft.

4. Licence & Usage

We grant you a non-exclusive, non-transferable, revocable licence to use the Add-in for your personal or internal business purposes. You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service for any illegal activity or to send prohibited content.
• Attempt to bypass any service limitations or security measures.
• Resell, sublicence, or redistribute the Service without written permission.

5. Acceptable Use & Anti-Spam

You are strictly prohibited from using Formu-Letter to send unsolicited bulk email (spam). You must comply with all applicable anti-spam legislation, including but not limited to CAN-SPAM (US), GDPR (EU), CASL (Canada), and the Spam Act 2003 (Australia). We reserve the right to terminate access if we receive reports of misuse.

6. User Data & Privacy

As detailed in our Privacy Policy, we do not store your spreadsheet data, email content, or recipient lists. You are solely responsible for the accuracy of the data you process and the content of the emails you send using the Service.

7. Intellectual Property

All rights, title, and interest in the Service — including its code, design, and branding — remain with the creators of Formu-Letter. Nothing in these terms grants you any rights to our trademarks or intellectual property beyond the limited licence described above.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or compatible with all Microsoft 365 configurations.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Formu-Letter and its creators shall not be liable for any indirect, incidental, special, or consequential damages — including but not limited to data loss, service interruptions, or undelivered emails — arising from your use of the Service.

10. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, if we believe you have violated these terms or if required by law or Microsoft policy. You may stop using the Service at any time by uninstalling the Add-in.

11. Changes to These Terms

We may update these Terms of Service from time to time. Any changes will be reflected on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.
